For the traveller

1. To you as a traveller, it does not cost anything to use theZouk. The service is free. theZouk is a marketplace which manages enquiries and provides quotations electronically between the receiver and the sender. After you have registered your details with theZouk, you should register your requirements regarding your accommodation. After that, your enquiry will be sent via theZouk to various private individuals and companies referred to as Accommodation suppliers, offering board and lodging in those areas and at the time specified - as you have requested. You will then receive quotations from the Accommodation suppliers who will be able to offer you board and lodging best matching your enquiry.

2. Each quotation is an offer to you personally. The terms and conditions in the quotations vary, but they will include details of the price of the accommodation, payment terms, cancellation requirements, information regarding the period of validity etc. You can open and read the quotations without it costing you anything. You do not need to accept any of the quotations that you have received. You can allow them all to lapse by not accepting any of them. If you do want to accept a quotation, click on the Accept button. You are then tied by the terms in the quotation which you have accepted. The quotation becomes an agreement between yourself and the Accommodation supplier which specifies what applies for your accommodation. When a quotation has been accepted, the other Accommodation suppliers who provided quotations through theZouk will receive a message that their quotations have been declined. theZouk does not assume any responsibility for the information in the enquiries or quotations which have been passed on via theZouk, nor does theZouk assume any responsibility for the traveller or the Accommodation supplier fulfilling their obligations. theZouk only ensures that enquiries and price quotations are sent electronically between the traveller and the Accommodation supplier and vice versa, below referred to as "The Service".

3. Each enquiry from a traveller which is passed on from theZouk to an Accommodation supplier, is anonymous. It is only when a traveller has accepted a quotation that theZouk forwards the traveller's name, choice of language and last specified e-mail address. As a minimum requirement, you must register your name, language choice and your e-mail address in order to use The Service. These obligatory details are marked with the star*. If you choose to fill in the non-obligatory details in the application for membership, this information will also be forwarded to the Accommodation supplier whose quotation you have accepted. 4. If you tick the alternative to receive Newsletters from theZouk you will receive a regular Newsletter in accordance with the alternatives you have chosen. Whenever you feel like, you can cancel your subscription to the Newsletter.

5. When you have filled in the obligatory registration details, you will be registered with theZouk as a member. You will therefore have the possibility of sending out enquiries and receiving quotations from Accommodation suppliers. When the necessary information has been sent to theZouk you will receive confirmation that the registration has been made and that The Service may be used.

6. Whenever you feel like, you can cancel this agreement. A cancellation period of two working days applies. theZouk has the right to cancel this agreement without a period of notice, by which the agreement is terminated immediately if theZouk discovers that you are taking advantage of The Service in any way. When the agreement has been terminated, theZouk is responsible for customer information not being used on the marketplace. This means that customer information may be saved on backup copies for filing purposes or otherwise in accordance with what is required with mandatory statute.

7. If you discover any shortcomings or something wrong with The Service, or if you would like to make any changes or amendments, you are welcome to contact theZouk.

8. All information which the Accommodation supplier provides on registration, with the exception of credit card details, will be registered and saved in theZouk's customer register during the period of validity of this agreement. This information will be treated confidentially and will not be given out to a third party. The information provided will be used to execute this agreement. Information will also be used as a basis for statistics, marketing and business analyses, but only for internal usage.

9. Disputes attributable to this agreement, shall be decided in a Swedish court in accordance with Swedish law, without consideration to Swedish conflict of law rules.

For the accommodation provider

1. By filling in the registration details, the company/private individual is registered as a supplier ("Accommodation supplier") for board and lodging for travellers to the areas specified. When registered, the Accommodation supplier is given the opportunity of providing quotations to travellers who are registered with theZouk. theZouk handles queries from travellers ensuring that they are passed on electronically to Accommodation suppliers in those countries which the enquiries relate to.

2. Each enquiry from a traveller that is passed on from theZouk, is anonymous. It is up to the Accommodation supplier to either provide a quotation or to decline from providing a quotation in response to an enquiry. The Accommodation supplier is responsible for all information and terms and conditions for any quotations made. It is therefore the Accommodation supplier's responsibility to provide a price, period of validity, terms and conditions for an open purchase, deal with returns, complaints, corrective action and other terms and conditions that apply in the price quotation with regard to the agreement between the Accommodation supplier and the traveller. theZouk does not assume any responsibility for the information in the enquiries or price quotations which have been passed on via theZouk, nor does theZouk assume any responsibility for the traveller or the Accommodation supplier fulfilling their obligations. theZouk only ensures that enquiries and price quotations are sent electronically between the traveller and the Accommodation supplier and vice versa, below referred to as "The Service".

3. When a quotation has been accepted by a traveller, theZouk passes the information on regarding the traveller's name and e-mail address and - if the traveller has agreed to it - information regarding home address and telephone number to the e-mail address which the Accommodation supplier has specified.

4. When theZouk has passed on an acceptance from a traveller, the agent's commission or brokerage charge will be levied, which at present is 8 Euro per acceptance. This will be debited from the credit card which the Accommodation supplier has specified. The commitment to pay the brokerage charge is made the instant theZouk forwards an acceptance of a price quotation, irrespective of whether or not the Accommodation supplier has read the acceptance. theZouk has the right with 30 days notice to change the brokerage charge via e-mail to the Accommodation supplier's last specified e-mail address.

5. When the information in accordance with section 1 above has been filled in, the Accommodation supplier will receive confirmation by e-mail from theZouk. Confirmation will include a request that the Accommodation supplier should specify details regarding credit card type, credit card number, the credit card's validity and the security code (CVV2/CVC2), in order for the brokerage charges to be transferred electronically to theZouk. The credit card details will be treated confidentially by a Payment Service Provider ("PSP") which guarantees that the credit card information will be handled with the highest security via SSL encrypted communication and client-key-based encryption for the storage of information. theZouk does not store information regarding credit card details. When all information has been sent to theZouk, the Accommodation supplier will receive confirmation that the registration has been made.

6. The Accommodation supplier and theZouk have the right to terminate this agreement with a period of notice of 10 working days. When the agreement after the period of notice has ended, all debited brokerage charges must be regulated. theZouk has the right to cancel this agreement without a period of notice, by which the agreement is terminated immediately, if theZouk discovers that the Accommodation supplier is taking advantage of the market place in any way. If this situation arises, all brokerage charges must be regulated immediately. When the agreement has been terminated, theZouk is responsible for customer information not being used on the marketplace. This means that customer information may be saved on backup copies for filing purposes or otherwise in accordance with what is required with mandatory statute.

7. In case of defects in The Service, the Accommodation supplier shall, at the latest within five working days from the time the defect was discovered, complain about the defect by sending an e-mail to theZouk. Should the Accommodation supplier fail to correct the defect within the specified time, the Accommodation supplier loses the right to make any claims on theZouk with regard to the defect. Debited brokerage charges will not be repaid.

9. Disputes attributable to this agreement, shall be decided in a Swedish court in accordance with Swedish law, without consideration to Swedish conflict of law rules.
